Závozda, Lukáš ; Vysokajová, Margerita (advisor) ; Štefko, Martin (referee)
The topic of the thesis is agency employment. Due to its flexibility and the current situation on the Czech labour market struggling with a labour shortage, agency employment is a frequently used and necessary part of the Czech legal system. In the Czech legal regulation of agency employment, however, we find a number of problematic areas, as a result of which, among other things, the rights of employees temporarily assigned by employment agencies may be jeopardized and insufficiently ensured, or, on the contrary, entrepreneurs operating employment agencies may be unnecessarily burdened. The main goal of this diploma thesis is to describe the problematic aspects of the Czech legislation in the field of agency employment with an emphasis on the legal regulation of the establishment and operation of employment agencies and selected frequently violated or problematic obligations in the field of agency employment relations, in relevant cases to compare these problematic aspects with foreign legal systems and propose a possible corresponding amendments to the Czech legislation. The diploma thesis is divided into six main chapters, which are further divided into individual subsections. The first chapter deals with the general characteristics of agency employment and further briefly describes the subjects...

Title of the thesis: Temporary agency employment Abstract The topic of this diploma thesis is temporary agency employment. Temporary agency employment is a type of employment intermediation realized with the cooperation of three entities - the employment agency, the user undertaking and the temporary agency worker. Based on this institute of labour law, temporary agency workers may be assigned to user undertakings to work there temporarily. Temporary agency employment is a popular way of recruiting a labour force, as it provides the possibility to respond relatively quickly and effectively to the need to increase or decrease the number of employees. This work aims to summarise the essential characteristics of temporary agency employment and to point out some problematic aspects of the Czech legislation related to temporary agency employment. The text of this thesis is divided into six chapters. The first chapter deals with employment intermediation and its individual forms. One of these forms is a temporary agency employment, to which the rest of the chapters are devoted. The second chapter is dedicated to the temporary agency employment definition and the characteristics of this institute in terms of its basic attributes: atypicality, flexibility, and precariousness. The aim of this diploma thesis is to offer a complete overview of the institute of temporary agency work. Temporary agency work is an institute that brings to the user undertakings the possibility to quickly adapt to the increase or decrease in demand for their products by changing the number of employees. The first part of the diploma thesis presents a brief excursion into the history of temporary agency work with focus on the most important historic moments and includes the explanation of its impacts. This chapter emphasises Czech history of temporary agency work, but it takes a quick glance at the history of temporary agency work in other states. The institute of temporary agency work was introduced to the Czech legal system as late as 2004. This point is very important to understand the uneasy position of agency employment on our labour market. The main part of this diploma thesis concerns current legal status of temporary agency work. It analyses obligations of the Czech Republic arising from the C181 and directive 2008/104/ES. The thesis continues to the Czech legal system and it analyses the positions of a private employment agency, user undertaking and an agency employee. Agency employment
Eliášová, Věra ; Pichrt, Jan (advisor) ; Morávek, Jakub (referee)
Temporary agency work Abstract The theme of this thesis is temporary agency work. Temporary agency work has been a part of the global conversation on flexible employment for most of the 20th century. Now, thanks to the labor market changes and the changes in the attitude toward "atypical work", it's becoming more relevant than ever. The main objective of the legislative efforts related to temporary agency work on global, European and national level is to find the right balance between the necessary flexibility and protection for temporary agency workers. Temporary agency work is a relatively new institute to the Czech legal system and as a result of that, the national legislation is still developing. This thesis is divided into four chapters that are, except for chapter two, focusing on the current legislation of temporary agency work in the Czech Republic. The first chapter provides a definition of temporary agency work and classifies it as "atypical work". It also points out its place in the Czech legal framework as a form of employment intermediation. The second chapter describes the evolution of the legislation on temporary agency work on an international and European level. Special attention is paid to conventions adopted by International Labour Organization and in particular to the Convention C181 -...

Agency Employment Abstract My diploma thesis is focused on the agency employment. The institute of agency employment was integrated to our system of the legal regulations in 2004 and nowadays it is a very popular alternative of traditional employment. Employers perceived it as an institute that enables them to react quickly and effectively to the changes which take place on the labour market and therefore gain the needed employees in the right time. I decided to write about this topic mainly because agency employment is very interesting issue with great business opportunities, but unfortunately the Czech regulation isn't as complex and clear as it could be. Therefore, I find this topic quite intriguing. The thesis is divided into introduction, conclusion and six more chapters. First chapter introduces the term and origin of the institute of agency employment within the Czech system of legal regulations. Next chapter focuses on the legal regulation of agency employment. Firstly, I mention very briefly history of the agency employment legislation, then I focus on the international legislation of the agency employment and last but not least I also give a short excursion into European legislation. In the third and fourth chapter I analyse in depth private law aspects of the agency employment and then also...
